LAS VEGAS, Nev. (FOX5) - The suspect in a Henderson police shooting was previously on house arrest months before, records show.

The Henderson Police Department arrested 43-year-old Jonathan Gaston for a shooting that happened January at Boulder Highway and Lake Mead Parkway.

REPORT: Sergeant needed 11 staples in his head after police shooting in Las Vegas Valley

Police said it started with a stolen license plate that was read on a Jeep.

According to an arrest report, when a Henderson sergeant approached the Jeep, Gaston would speed toward him.

Sergeant Alward shot at the Jeep five times, with at least one of the bullet’s Gaston’s arm.

Gaston continued to flee, hitting the sergeant and two other cars. He and his passenger would start fleeing on foot. Police later apprehended him and release the passenger.

Gaston faces five charges in connection with this shooting:

  • Attempted murder of a police officer with a deadly weapon
  • Battery with a deadly weapon resulting in SBH (substantial bodily harm)
  • Resist public officer with a deadly weapon
  • Duty to stop at the scene of an accident
  • Buy/possess/receive stolen property

FOX5 learned that Gaston was on house arrest before this shooting occurred.

According to an arrest report from Las Vegas police, he was released to a sober living facility on Oct. 7 of last year.

According to court records, he previously faced charges of battery, forgery, possession of schedule II drugs, concealing a weapon without a permit, resisting a public officer, attempted murder and more.

He was on house arrest with a leg electronic monitoring device. Two days later, supervision received an alert of tampering on his device.

Police would enter his room to find Gaston gone, his device damaged and left charging.

He was considered and absconder from that day. Las Vegas police learned on Jan. 24 that Gaston was arrested in Henderson Jail, about ten days after the Henderson shooting occurred.

He would be transported to the Clark County Detention Center. He is due in court on Feb. 11 for a preliminary hearing.
